An employee’s Priority Date is his/her “place in line” with respect to the permanent
residency process. The issue of priority date also plays a role with regard to the timing
of the permanent residency process. This will further be discussed below.

For the EB1 category, the priority date is established on the date the USCIS
receives Form I-140 Immigrant Visa Petition.
- For the EB2 and EB3 categories, the employee’s Priority Date is established as of
the date the labor certification is filed with the DOL.
For all visa categories, Form I-140 Immigrant Visa Petition must be approved in order for
the priority date to be officially assigned to the employee.
